XsunX, Inc. (the “Registrant”) is unable, without unreasonable effort or expense, to file its Annual Report on Form 10-K for the fiscal year ended September 30, 2015 (the “Annual Report”) by the December 29, 2015 filing date, due to unforeseen delays in the dissemination and review of the information required to be presented in the Form 10-K. Registrant respectfully requests an extension of the filing of its Annual Report on Form 10-K for the period ended September 30, 2015.
