Baron & Budd Representing Family in Wrongful Death Lawsuit of Victim Involved in Fatal Vanderhall Crash

The wrongful death lawsuit alleges the victim’s Vanderhall vehicle was defectively designed and unreasonably dangerous and exposed the vehicle occupant to an unnecessary risk of harm.

Today, the national law firm of Baron & Budd announced it is representing the family of a Houston man who was fatally injured in a single vehicle crash involving a Vanderhall Carmel vehicle. The victim was a husband and father to two children.

The crash occurred when the victim was travelling down a straight roadway and the Vanderhall’s rear wheel suddenly and without warning lost traction with the pavement, which caused the vehicle to lose stability and the driver to lose control. The Vanderhall fishtailed and veered to the right, striking the curb, and crashing into a building.

According to the lawsuit, the Vanderhall vehicle was unreasonably dangerous and defective in that it “lacked electronic stability control, lacked a properly functioning anti-lock brake system (ABS), and/or was vulnerable to instability and loss of control during expected and foreseeable operator use, among other defects.”

The suit also alleges that Vanderhall did not adequately warn consumers of the unreasonable risks and dangers associated with this defect and failed to take steps to recall or repair the vehicles. Several people have been involved in deadly crashes involving the Vanderhall 3-wheel autocycles. In these accidents, the drivers of the Vanderhalls have unexplainably lost control and crashed.

“We have seen that the Vanderhall autocycles can be very dangerous and even deadly,” said Baron & Budd attorney, Bryan Green. “Many Vanderhall owners do not know the risks created by the company’s decision not to use electronic stability control. The company needs to be held accountable for blatantly disregarding the safety of consumers and designing, manufacturing, and marketing a defective product that causes unreasonable risks to consumers.”

Baron & Budd has represented plaintiffs in some of the most high-profile automobile defect cases. Our attorneys filed the first lawsuit in the Takata Airbag Recall and represented plaintiffs in the Volkswagen Audi Emission Fraud Lawsuit.
